Mold in Homes: What Tenants and Owners Need to Know

Whether you want to call it yucky, blegh, or just plain gross, mold is not a fun topic, but if you are a tenant or homeowner, it is an important one. According to the Centers for Disease Control and Prevention, mold is a fungal growth that forms and spreads on various kinds of damp or decaying matter. Excess moisture is the primary cause of indoor mold, which reproduces by releasing tiny spores that float through the air and land in other locations. When they settle on wet or moist surfaces, they can form new mold colonies.

No indoor space is completely free from mold spores. However, mold in residential property is a common and sometimes serious problem, causing various health issues including asthma, respiratory infections, breathing symptoms, and skin rashes, depending on the species.

You Control the Moisture, You Control the Mold

Since mold cannot be eradicated completely, steps should be taken to control it as much as possible by removing excess moisture. Simply wiping up visible mold, even with a bleach solution or other cleaner, will not eradicate it and does not address the cause of its growth.

If the excess moisture is caused by water vapor (think long, hot showers), mold is best controlled by running an exhaust fan for 10-20 minutes after showering and opening doors and windows. Exhaust fans are sized by CFM (cubic feet per minute) of air evacuation based on the room’s square footage. Home builders and contractors often undersize exhaust fans to reduce costs, but you can easily check the CFM rating of your fan by taking off the cover; however, we only recommend this for homeowners. Tenants should contact the property manager.

If the excess moisture is caused by a broken or leaking pipe or a flood event, simply drying out the area is probably not sufficient. Homeowners should contact a mold remediation contractor or their insurance company immediately. Often a single flood event will require removing and replacing sheetrock, insulation, and treating or replacing subflooring and wall studs.

Be aware of the warning signs of mold—visible mold, water damage, damp materials, or mold odor. If you are a tenant, you should alert your landlord immediately. Homeowners should contact a mold remediation contractor.

Mold Testing and Remediation

The presence of mold is tested by taking several air samples with specialized collection equipment in different areas of the home. Samples from the problem site are compared against the baseline samples in other areas and sent to a laboratory to test for elevated spore levels.

For property owners with confirmed findings of elevated mold levels, it is imperative to begin remediation immediately. Depending on the event causing the mold, the remediation may be covered by insurance. But even if not covered, failing to remediate mold will exacerbate problems and likely run afoul of Landlord-Tenant law regarding habitability of rental units.

Neither California nor Montana has state regulations about mold inspection, assessment, or remediation. However, contractors performing mold remediation repairs must be licensed by their respective states. Mold remediation contractors may also be trained and certified by private organizations that specialize in mold remediation.

Andrew Kucera is a California-licensed attorney, real estate broker, and principal/general counsel of Valley Vista Properties. As an attorney, he practices real estate and business transactional law, including landlord-tenant issues, evictions, contracts, dispute resolution, zoning and land use, entity formation, and corporate compliance. Andrew is also an Adjunct Professor of Law at San Joaquin College of Law (SJCL) in Clovis, CA, where he has won multiple Adjunct Faculty of the Year awards.

In 1997, Andrew earned a Bachelor of Arts, Cum Laude, with Distinction in Economics and a minor in Real Estate from San Diego State University. At SDSU, he received nominations from the national honor societies Phi Beta Kappa and Golden Key.

Andrew, the 2013 valedictorian, earned his Juris Doctor with High Honors from SJCL. In 2005, he earned a master’s in business administration from the Craig School of Business at California State University, Fresno (CSUF).

An avid volunteer, Andrew serves as a member, past President, and past Team Leader of the Fresno County Sheriff’s Search and Rescue Mountaineering Team, a volunteer SAR team that assists with wilderness search and rescue missions in Fresno County and mutual aid missions throughout California.

Andrew is married to Karin Kucera, and they have two wonderful children. Together, they enjoy camping, hiking, backpacking, horsepacking, reading, gardening, and road trips.

David Kucera is a licensed California Real Estate Broker with Valley Vista Properties and a member of the Fresno Association of Realtors and the Clovis Chamber of Commerce. A real estate broker since 1978, David founded Santa Clara Properties in Palo Alto, California, and is also a member of the Silicon Valley Association of Realtors in Cupertino, California.

David is an owner and co-founder of Valley Vista Properties, which was started in Fresno in 2004 as a real estate company and continues to be family-owned and operated to this day. It has expanded over time from representing buyers and sellers of real estate to adding a state-of-the-art professional property management division to aid owners of investment properties.

He began his real estate career in the San Francisco Bay Area, using creative, innovative approaches that helped buyers own residential property in the high-priced Bay Area. He established an equity-sharing program that enabled unrelated buyers to purchase residential property through an equity-sharing arrangement (combining an investor with an owner/occupant), a highly successful initiative that was featured in the San Francisco Chronicle. In addition to the equity-sharing program, David offered a down payment assistance program, which again helped many families own their first home.

Through Valley Vista Properties, David has been a licensed real estate mortgage broker, helping guide many residential buyers through the often-complex mortgage loan approval process. He continues to educate prospective buyers about the numerous loan options available to residential buyers, including both owner-occupant buyers and investors.

David holds an undergraduate degree from the University of California, Davis; a Master of Science in Mathematics from San Jose State University; and a Master of Science in Operations Research from Stanford University. Additionally, he has completed advanced real estate courses and earned the Graduate Realtor Institute (GRI) designation from the California Association of Realtors.

Karin Kucera is co-founder and principal of Valley Vista and an Accredited Residential Manager (ARM®) with more than 16 years of experience in real estate sales and property management. She specializes in Harlan Ranch, Quail Lake, and Clovis Unified School District in both sales and rentals.

While developing her real estate sales, Karin was instrumental in establishing Valley Vista’s property management business and now manages a portfolio of more than 100 rental properties in Clovis, Fresno, and Sanger. Her experience spans 32 years in business management, marketing, and technical training.

When not engaged in her passion for helping clients achieve their financial goals through real estate investment, Karin can be found traveling with her family.
